Construction

The Vogel Law Firm has been synonymous with the practice of construction law over the last 50 years. This identification started with Philip Vogel, who represented many of the contractors in the state, and handled the first arbitration claim with the North Dakota Highway Department. Philip was well known for his excellent representation of clients involved in construction disputes, but even more so for his expertise in assisting clients to resolve disputes prior to litigation or arbitration. His dedication and expertise have been continued by current members of the firm. Their experience in construction law, as well as knowledge of construction contracts, plans, and specifications, allow them to get right to the meat of disputes and problems. The firm has represented for many years, and continues to represent, the Association of General Contractors.

The firm has represented all parties who have been involved in construction disputes, including:

  • Contractors and Subcontractors. This involves all forms of representation, including negotiation of contracts, bidding disputes, construction defect claims, dealing with problems between subcontractors and general contractors, suppliers, bond claims and claims for additional compensation.
  • Owners. This includes representation of owners as they negotiate construction contracts with architects, engineers and contractors, and problem resolution, either by negotiation, arbitration, or litigation on problems arising during the course of, or following, construction.
  • Architects and Engineers. This includes assisting in contract formation, resolving disputes with owners or contractors, defending or presenting design defect claims and general representation.
  • Bonding Companies. This includes all aspects of bonding claims, representing both the bonding company in defending such claims, or owners, contractors, suppliers, or subcontractors in making claims on performance and payment bonds.
  • Suppliers. This includes assisting suppliers in getting paid on projects and making claims against designers and manufacturers when problems arise with items that have been supplied.

Members of this practice group have been involved in hundreds of claims, arbitration proceedings and trials involving all aspects of construction law.
