Environmental, Water Law & Land Use

Environmental law, water law and land use management comprise an important part of the Vogel Law Firm’s practice. Our attorneys’ experience spans the history of the development of modern environmental law, with one attorney even instrumental in promulgating North Dakota’s environmental laws in the 1970s. Our attorneys actively counsel clients on corporate and regulatory issues, as well as litigate environmental tort, pollution and water law claims in North Dakota and Minnesota state and federal courts.

We have represented virtually all parties involved in environmental, water and land use disputes, including political subdivisions, land owners, property buyers and sellers, private businesses and public interest groups. Vogel’s broad-based environmental law practice covers a variety of substantive areas, including:

  • Consultation on Phase I and Phase II analysis for buyers and sellers of contaminated property.
  • Tort litigation, including that arising from lead paint, mold, asbestos, chemical spills, landfills and leaking underground and aboveground storage tanks.
  • Interstate, intrastate and international water rights disputes.
  • NEPA and Environmental Impact Statement consultation and litigation.
  • Flooding and dike disputes amongst landowners.
  • Negotiating notices of violations with the North Dakota State Health Department and the Minnesota Pollution Control Agency.
  • Assisting property owners, buyers and sellers through the MPCA Voluntary Investigation and Clean-Up Program (VIC) and Voluntary Petroleum Investigation and Clean-Up Program (VPIC).
  • Superfund cost recovery and actions to allocate financial responsibility.
  • Insurance recovery for environmental cleanup costs, property damage and bodily injury claims.
  • Solid and hazardous waste management issues, including EPA, FAA and OSHA administrative matters.
  • Litigation and compliance with state and federal air, water and hazardous materials laws and permitting requirements.
  • Condemnation, zoning and land use proceedings.
  • Agricultural chemicals.
  • Feedlot regulatory issues.
  • Environmental criminal defense.
