The Vogel Law Firm was one of the first in North Dakota to develop expertise in product liability litigation. Our lawyers have handled many prominent cases in the tri-state area through both trial and appellate processes involving industrial and construction equipment, motor vehicles, farm machinery, medical devices, asbestos exposures and numerous durable consumer products. We have represented most participants in the chain of distribution, from designers and manufacturers to retailers.

We have developed expertise in recall, retrofit and post-sale warning and product inspection issues and have experience dealing with the governmental agencies concerned with manufacturer's post-sale duties. We have practical experience in guiding manufacturing clients through critical self-analysis involving all varieties of safety issues, design and warning changes and resulting legal repercussions. We have also advised clients about the wording and presentation of warranties, disclaimers and instructions, as well as on-product warnings.

Our Products Liability Practice Group has drafted products legislation and analyzes the impact of state and federal legislation and regulations relating to product development and use. We work closely with the American Tort Reform Association (ATRA), Lawyers for Civil Justice (LCJ), Defense Research Institute (DRI) and other trade groups monitoring legislative developments. We provide briefings relating to changes in statutory and case law affecting businesses involved product distribution.
