The National Labor Relations Board (NLRB) has determined that facially neutral rules requiring confidentiality during workplace investigations may affect an employee’s Section 7 rights under the National Labor Relations Act (NLRA), but any adverse impact would be slight and outweighed by the substantial and important justifications associated with maintaining the rules, particularly with respect to open investigations. Accordingly, an employer’s confidentiality rule would be “presumptively valid” to the extent it is limited to an open investigation.
